Open Call Rules

HET REGLEMENT  

Art.1. - Deze wedstrijd wordt gereorganiseerd door de stad Kortrijk in het kader van het fotofestival Track & Trace. Aan deze wedstrijd is een tentoonstelling gekoppeld, die doorgaat van zaterdag 13 maart 2021 tot en met zondag 25 april 2021. De winnaar en laureaten maken kans op een publicatie in De Standaard. Het doel van de wedstrijd is de ondersteuning en de promotie van documentaire fotografie.  De jury beslist autonoom en zonder verhaal of een ingezonden reeks als documentaire fotografie kan beschouwd worden.  

Art.2. -  Door aan de wedstrijd deel te nemen aanvaardt de fotograaf onherroepelijk de inhoud van dit reglement. 

Art.3. – Elke deelnemer mag voor de wedstrijd min. 5 - maximaal 15 foto’s indienen, die een reeks moeten vormen in verband met een bepaald thema.  

Art.4. – De ingediende foto’s dienen een recente reeks te zijn, niet ouder dan 3 jaar.   
Deelname aan de wedstrijd staat uitsluitend open voor meerderjarige professionele fotografen in hoofd- of bijberoep of fotografen die maximum 5 jaar zijn afgestudeerd aan een Academie of Kunstschool, en die wonen, werken of geboren zijn in België. De organisator kan fotografen van deelneming uitsluiten, indien zij omtrent deze hoedanigheid geen afdoend bewijs kunnen voorleggen.  

Art.5.- Deelnemen kan uitsluitend online via deze website. De foto’s moeten opgeladen worden tussen donderdag 8 oktober 2020 en zondag 15 november 2020. De foto’s dienen te beantwoorden aan de technische en andere voorwaarden die op deze website worden gepreciseerd. Inzendingen, die niet aan deze voorwaarden voldoen, zullen door de organisator uitgesloten worden van deelneming aan de wedstrijd.  

Art.6.-  De winnaar krijgt de ROOTS prijs (aangeboden door Roots Advocaten, Kortrijk), ter waarde van 5000 €. De tweede prijs is een geldprijs (Stad Kortrijk) van 1500 euro. En de derde prijs is een printprijs (Fotorama), ter waarde van 1500 €.

Art.7. De samenstelling van de jury wordt bekend gemaakt op deze website.

Art.8.- De jury beslist in volle autonomie. Tegen haar beslissing staat geen enkel verhaal open. Zij dient haar beslissing op geen enkele wijze te verantwoorden en zal niet over haar beslissing communiceren met de deelnemers. 

Art. 9.- De vijf geselecteerden krijgen een productiebudget van 500 EUR voor het printen van hun werk. Printen van het werk zal gebeuren in samenspraak met de curator van de expo. Het werk van de vijf laureaten wordt tijdens het fotofestival in de Paardenstallen geëxposeerd.

Art. 10.- De organisator is op geen enkele wijze aansprakelijk voor de ingezonden foto’s in geval van een kwaliteitsverlies of verlies tijdens of naar aanleiding van het uploaden van de foto’s. 

Art. 11.- Door zijn deelname bevestigt de deelnemer dat de ingezonden foto’s origineel zijn en dat hij de enige houder is van de intellectuele eigendomsrechten verbonden aan deze foto’s. Hij verklaart uitdrukkelijk te beschikken over alle rechten, verbonden aan de ingezonden foto’s. Hij verklaart ook te beschikken over de toestemming van de betrokkenen om de foto’s te maken en aan het publiek mee te delen. De organisator aanvaardt geen enkele aansprakelijkheid terzake en zal in voorkomend geval door de deelnemende fotograaf gevrijwaard worden voor alle schade en kosten. 

Art. 12.- Door zijn deelname geeft de deelnemer aan de organisator toestemming om de ingezonden foto’s zonder enige vergoeding te publiceren op deze website en in het kader van promotie tijdens het festival Track & Trace. 

Art. 13.- Door zijn deelname verbindt de deelnemer er zich toe dat de ingezonden foto’s alle geldende wetgeving respecteert en dat de foto’s meer bepaald: niet ingaan tegen de openbare orde en goede zeden; de rechten, inzonderheid de intellectuele eigendomsrechten, van derden naleven; geen afbreuk doen aan de reputatie, de persoonlijke levenssfeer en het imago van derden; geen denigrerende of beledigende uitlatingen bevatten; geen pedofiele of pornografische kenmerken vertonen; geen afbreuk doen aan de veiligheid van een staat of een gebied; niet tot discriminatie aanzetten, ongeacht of de discriminatie is gebaseerd op geslacht, religie, nationaliteit, invaliditeit, seksuele geaardheid, leeftijd of politieke opinies; geen aanleiding geven tot het plegen van misdaden, stafbare feiten of terroristische daden. De bovenstaande lijst is niet limitatief. De jury beslist hieromtrent in volle soevereiniteit.  

Art. 14. – De winnaar(s), zullen door de organisator verwittigd worden van de uitslag. 
 
Art. 15. – Deelnemers kunnen met de organisator communiceren in het Nederlands, het Frans of in het Engels. De organisator zal in het Nederlands communiceren.  

Art. 16.- De gegevens van de deelnemers zullen door de organisator verwerkt worden overeenkomstig de GDPR-reglementering worden toegekend.  

Art. 17.- De wedstrijd en onderhavig reglement zijn onderworpen aan het Belgisch recht. Alleen de rechtbanken van Kortrijk zijn bevoegd om van alle welke geschillen ook in verband met de wedstrijd of het reglement kennis te nemen. 

THE RULES 

Article 1 – This Open Call is reorganised by the city of Kortrijk as part of the Track & Trace photography festival. This competition is linked to an exhibition, which runs from Saturday 13 March 2021 to Sunday 25 April 2021. The winner and laureates can win a publication in De Standaard newspaper. The competition’s objective is to support and promote documentary photography. The jury is solely responsible for independently deciding whether a submitted series is considered as documentary photography.   

Article 2 – By participating in the competition, the photographer irrevocably accepts the content of these rules.  

Article 3 – Each participant is required to submit a series of at least 5 and at most 15 photographs with a specific theme.   

Article 4 – The series of submitted photographs must have been taken less than 3 years ago. 
Participation in the Open Call is restricted to people who live, work or are born in Belgium and who are pursuing professional photography as their main or secondary occupation or who graduated from an Academy or School of Art with a photography qualification less than 5 years ago. The organiser reserves the right to exclude photographers who are unable to provide conclusive proof in this regard.   

Article 5 – Participation is only possible online via this website. Photographs must be uploaded between Thursday October 8th 2020 and Sunday November 15th 2020. The photographs must comply with the technical and other conditions specified on the website. The organiser shall exclude any entries that do not meet these conditions from the competition.   

Article 6 – The winner shall receive the ROOTS prize (offered by Roots Lawyers, Kortrijk), worth €5,000. The runner up shall receive a cash prize of €1,500 (City of Kortrijk). The third prize is a printing prize, worth €1,500 (Fotorama). 

Article 7 – The members of the jury shall be announced on the website. 

Article 8 – The jury’s decision shall be wholly independent and final. The jury does not have to justify its decision in any way and shall not communicate about its decision to the participants.  

Article 9 – The five selected candidates will receive a production budget of 500 EUR for printing their work. The work of the five laureates will be exhibited in the Paardenstallen during the photo festival. The printing of the work will be done in collaboration with the exhibition curator

Article 10 – The organiser shall in no way be responsible for the submitted photographs if they are lost or if their quality is affected when or after they are uploaded.  

Article 11 – By participating, the participant confirms that the submitted photographs are originals and that he or she is the sole holder of the intellectual property rights associated with the photographs. The participant specifically declares that he or she holds all the rights associated with the submitted photographs. The participant also declares that he or she has obtained the consent of the relevant parties to take the photographs and show them in the public domain. The organiser shall not accept any liability in this regard and the participating photographer indemnifies the organiser against any damages and costs in that respect.  

Article 12 – By participating, the participant authorises the organiser to publish the submitted photographs on the website and to use them to promote the Track & Trace photography festival without any compensation.  

Article 13 – By participating, the participant confirms that the submitted photographs respect all applicable laws and regulations. The participant also confirms that the photographs do not violate public order and morality; respect the rights – particularly the intellectual property rights – of third parties; do not harm the reputation, privacy and standing of any third parties; do not contain derogatory or insulting remarks; do not have any paedophile or pornographic elements; do not compromise the security of a state or area; do not incite to discrimination, regardless of whether the discrimination is based on gender, religion, nationality, disability, sexual orientation, age or political opinions and do not incite anyone to commit any crimes, offences or acts of terrorism.  
The above list is not exhaustive. The jury shall decide on this matter fully independently.   

Article 14 – The organiser shall notify the winners of the results. 

Article 15 – Participants can communicate with the organiser in Dutch, French or English. The organiser shall communicate in Dutch. 

Article 16 – The organiser shall process the participants’ data in accordance with the GDPR. 

Article 17 – The competition and these rules are subject to Belgian law. Any disputes relating to the competition or these rules shall only be heard by the courts of Kortrijk.
